RESOLVED that the minutes of the Licensing Sub-Committee meeting held on 27th September 2017, be approved as a correct record and signed by the Chair.

The Sub-Committee considered an application for a new premises licence in respect of 83 Hexthorpe Road, Hexthorpe, Doncaster, DN4 0BE. 

 

The application originally sought to permit the sale of alcohol from 08.00 to 23.00 hours, Monday to Sunday. To prevent a representation from South Yorkshire Police, the applicant had agreed to reduce the hours for licensable activity and to place additional conditions on the licence should it be granted. A summary of the application showing the amended hours and additional conditions, was attached at Appendix B to the report.

 

Representations regarding the application had been received from a neighbouring business, a local resident and two Elected Members; copies of which were attached to the report at Appendix E.

 

In response to the representations, the Applicant requested that the Licensing Authority circulate an email, which provided further details of the proposed business, to those parties who had made representations. A copy of the email was attached at Appendix F to the report.

 

The agreement between South Yorkshire Police and the Applicant, to accept additional conditions and to reduce the permitted hours for the sale of alcohol, was attached at Appendix G.

 

The Applicant had indicated that a copy of the application had been sent to the Responsible Authorities.  Details of the application have been published on the Council’s website.

 

The Sub-Committee Members, the Applicant and Responsible Authorities, had received the agenda prior to the meeting.

 

The Chair made introductions and outlined the procedure to be followed.

 

The Applicant made representations and answered questions.

 

Councillor Glyn Jones, Local Ward Councillor for Hexthorpe and Balby who had made a written representation, made representations on behalf of Councillor Sue Wilkinson (local ward Councillor for Hexthorpe and Balby) and himself, in respect of their objections to the application and answered questions.

 

All parties were then asked to leave the room whilst the Sub-Committee deliberated on the application and reached a decision.

 

RESOLVED that the Licensing Sub-Committee having considered the application for a new premises licence in respect of 83 Hexthorpe Road, Hexthorpe, Doncaster, DN4 0BE, and having taken into account the written representations made and the evidence presented today, the steps that are appropriate to promote the Licensing Objectives, the Home Office Guidance and the Council’s Statement of Licensing Policy, have decided to grant the application in the terms as set out in Appendix B, subject to the following conditions:-

 

1.          Any alcohol in the premises will be covered so that it is not in public view during the times when alcohol is not permitted to be sold from the premises; and

 

2.          The till at the premises shall operate so as not to permit the sale of alcohol outside the hours that are permitted under the licence.
