Election of Chair.

Minutes:

Due to the absence of the Chair, Councillor Linda Curran, nominations were sought for the election of a Chair for this meeting.

 

Councillor Bev Chapman moved that Councillor Iris Beech be elected as Chair, which was subsequently seconded by Councillor Steve Cox

 

RESOLVED that Councillor Iris Beech be elected as Chair of the Licensing Sub-Committee, for this meeting.

RESOLVED that the minutes of the Licensing Sub-Committee meetings held on 22nd December, 2016 and 24th January, 2017, be approved as a correct record and signed by the Chair.

The Sub-Committee considered an Application for a new premises licence in respect of ‘EDA Supermarket’, 60 Hexthorpe Road, Hexthorpe, Doncaster, DN4 0BD.

 

The Sub-Committee Members, the Applicant, the persons making representations and the Responsible Authorities had received the agenda prior to the meeting.

 

Representations regarding the application had been received from Councillor Glyn Jones, Hexthorpe and Balby North ward Councillor (on behalf of residents of Hexthorpe and Councillor Sue Wilkinson), and the sub-postmaster at New Hexthorpe Post Office.  Copies of the representations were attached to the report at Appendix E. 

 

During the consultation period the applicant had agreed with South Yorkshire Police that additional conditions shall appear on the licence should it be granted. Details regarding the additional conditions were attached at Appendix F for Members’ consideration.

 

The Chair made introductions and outlined the procedure to be followed.

 

The Applicant and the Agent acting on behalf of the Applicant made representations and answered questions, during which the Applicant  amended her application in the following terms:-

 

-        Reduce the opening hours and sale of alcohol from 11.00pm to 10.00pm

 

-        The licence to be valid for the period of 6 months

 

Councillor Glyn Jones, Hexthorpe and Balby North ward Councillor, who had made written representations on behalf of the residents of Hexthorpe, was in attendance at the meeting and made representations in respect of their objections to the application.

 

All parties were then asked to leave the room whilst the Sub-Committee deliberated on the Application and reached a decision.

 

RESOLVED that the Licensing Sub-Committee, having considered an Application for a new Premises Licence for ‘EDA Supermarket’, 60 Hexthorpe Road, Hexthorpe, Doncaster, DN4 0BD, and having taken into account the relevance of the written representations made and the evidence presented at the meeting, the steps that are appropriate to promote the Licensing Objectives, the Home Office Guidance and the Council’s Statement of Licensing Policy,

decided to grant the Application in the terms as set out in Appendix B to the report, subject to the following amendments:-

 

·       That the terminal hour for the sale of alcohol shall be 10.00 pm; and

·       The licence shall be valid for a limited period, that being 6 months from the date of the hearing.

 

And be subject to the following conditions:-

 

A CCTV system will be fitted, maintained and in use at all times whilst the premises are open.

 

The CCTV images will be stored for 28 days and the Police and authorised Officers of the Council will be given access to images for purposes in connection with the prevention and detection of crime and disorder.

 

Members of the management team will be trained in the use of the system.

 

Challenge 25 Scheme – The Challenge 25 scheme must operate including, a refusals log, signage and the maintenance of staff training records.

 

No singular alcoholic drinks, including, beer, lager and cider in cans will be sold; a minimum purchase of 4 will be required.
