Minutes:

During discussion on the report, clarification was sought regarding the reasoning for the quashing of the enforcement notice for Application No 21/00857/M, 29 Kings Road, Wheatley, Doncaster DN1 2LU. Officers advised that the decision had been quashed due to a technical error regarding the description. The development should have been described as a 3-storey extension and not 2-storey.

It was then

Committee Overturn

21/00857/M

Appeal against enforcement action for alleged unauthorised erection of 2 storey extension, outbuilding and dormer window, and change of use of outbuilding to dwelling.  Under grounds That the reasons given in the Notice for Enforcement could be resolved through a planning application to be submitted, including the reduced height of the rear extension, the reduction of the front dormer roof to be below the ridge line and the removal of the terrace flat roof area to the rear of the property. This would make it in line with the neighbours developed rear elevations.  We are discussing with Sarah Smith at the Enforcement Team at Doncaster Borough Council about the submission of a planning application that would be in keeping with the reasons for the Notice of Enforcement. It is also noted, as per the OS plan that the existing rear building footprint as recorded in the OS plan protruded further than the other buildings, with existing Victorian structures.

The proposal would be to lower the height of the rear extension. To Omit the Roof Terrace, which would also reduce the roof height/ parapet height, and that the dormer would be bough in line with the lower ridge heigh needs. at 29 Kings Road, Wheatley, Doncaster, DN1 2LU
