Minutes:

RESOLVED that the public and press be excluded from the meeting in accordance with Section 100(A)(4) of the Local Government Act, 1972, as amended, on the grounds that exempt information as defined in paragraph 1 of Part 1 of Schedule 12(A) of the Act, was likely to be disclosed.

Minutes:

RESOLVED that the minutes of the meeting held on 13th October, 2015, be approved as a correct record and signed by the Chair.

Application for Transport Assistance (Exclusion Paragraph 1).

The Committee considered an Appeal in relation to transport assistance.

 

The Committee Members and the Appellants had received the agenda and the Hearings procedure prior to the meeting.

 

The Chair made introductions and outlined the procedures to be followed at the appeal hearing.

 

The Council’s representative presented the Council’s case and answered questions from Members of the Committee and the Appellants.

 

The Appellants, made representations and answered questions.

 

The Council’s representative was given the opportunity to ask questions of the Appellant.  No questions were asked of the Appellant by the Council’s representative.

 

The Council’s representative made a closing statement.  No closing statement was made by the Appellant. 

 

All parties were then asked to leave the room whilst the Committee deliberated on the Application and reached a decision.  Both parties were informed that they would be notified in writing of the decision.

 

5. (a) Appeal Case No. 1207

 

RESOLVED that having considered all the circumstances, the information set out in the report and the representations and evidence presented at the meeting, Case No.1207, be allowed on the grounds that the reasons put forward in support of the appeal were considered worthy of the Committee exercising its discretion to grant an exception and award transport assistance; and

 

RECOMMENDED that the Statutory Qualifying Distance as set out in the Council’s Home to School Transport Policy (July 2015), provide further clarity with regard to the meaning of the nearest ‘designated ‘entrance’ of the school or college to which assistance is being considered under the relevant clause of the policy.
