The Committee considered an application for a new premises licence for Dunscroft Garage, Broadway, Dunscroft, DN7 4HU.


The application was brought before the Committee due to the number of representations from local residents with their concerns to the four licensing objectives.


The Sub-Committee Members, the applicant and the Objectors making representations had received the agenda papers prior to the meeting.


At the commencement of the hearing, the Chair made introductions and outlined the procedures to be followed.


The Licensing Officer introduced the report and outlined the salient points.


The Applicant, Mr Namani, and his supporter, Mr Evans, addressed the Committee and outlined the key points and answered questions.


All parties were then asked to leave the room whilst the Sub-Committee deliberated on the application and made their decision.


RESOLVED that having considered the application for a Premises Licence for Dunscroft Garage, Broadway, Dunscroft, Doncaster, DN7 4HU and taken into account the written representations made and the evidence presented today, the steps that are appropriate to promote the Licensing Objectives, the Home Office Guidance and our Statement of Licensing Policy and noting the amendments made to the licensed premises area put forward, the Committee have decided to grant the licence in the terms set out in Appendix B as amended subject to the following conditions:-


1)    A litter bin to be placed outside the retail unit to be emptied at the close of trading each day; and


2)    A member of staff to be inside the licensed premises at all times during the licensed premises opening times.


The Applicant says that he has owned the garage for 12 months and has held a personal licence for 2 years. The business is an MOT and a car maintenance garage with a car sales business and car wash as well as the shop. Regarding the representations, when he first had the business, there was a problem with people gathering and so put in barriers at the front. Since then, there has been no problem with either youths gathering, or litter accumulating. If any youths did gather, he would move them away and additionally would put in a litter bin outside. The Committee agree this is relevant and have dealt with this by way of a condition.


The Committee was pleased to note the Applicant had liaised with the police and had agreed additional conditions not least relating to CCTV which the Committee believes will help to promote the licensing objectives.


As part of the police liaison, the Applicant is also adopting Challenge 25. The Committee believes that operating Challenge 25 is an important consideration and believe the added conditions will ensure it is promoted.


The petrol pumps are attended, meaning that a member of staff tenders the petrol for the customer. This means there is the potential for the store to be empty unless there are at least two members of staff working at any one time.
