The Sub-Committee considered an application for a new premises licence in respect of ‘Super Fryer’, 231 Beckett Road, Wheatley, Doncaster, DN2 4BB.

 

The Sub-Committee Members, the Applicant, the person making representations and Responsible Authorities, had received the agenda prior to the meeting.  A copy of the representation was attached to the report at Appendix E.

 

At the commencement of the hearing, the Chair welcomed all parties to the meeting, made introductions and outlined the procedure to be followed.

 

As the hearing was being held via a teleconferencing facility, Members of the Sub-Committee and other parties, were informed by the Chair that she would indicate who would speak next in order to ensure that the meeting ran as smoothly as possible.

 

The Senior Licensing Practitioner, Hayley Oxley introduced the report and outlined the salient points in relation to the application.

 

The Applicant, Mr Pillai was in attendance at the meeting.  The Applicant’s Agent, Mr Stephen Butler was also in attendance, made representations and answered questions.

 

Ms Colette McManus who had made written representations in respect of the application, outlined her concerns and objections to the application, and answered questions.

 

The meeting was then adjourned to allow the Sub-Committee to deliberate on the application and reached a decision in private.

 

All parties were then invited back in to the meeting to be informed of the Sub-Committee’s decision.

 

RESOLVED that the Sub-Committee, having considered the applicationfor a new Premises Licence in respect of ‘Super Fryer’, 231 Becket Road, Wheatley, Doncaster, DN2 4BB, have taken into account the representations made and the evidence presented today, the steps that are appropriate to promote the Licensing Objectives, the Home Office Guidance and the Statement of Licensing Policy, and decided to grant the licence in the terms set out in Appendix B and Appendix D.

 

The Sub-Committee noted that the Applicant lives above the premises and as such has more reason not to have anti-social behaviour around the premises.  It was also noted that the Applicant has been a retailer for some time and discussed the application with the Police in advance.

 

Ms McManus addressed the Sub-Committee and explained that she intended no offence by the wording in her objection.  Ms McManus explained that she does not feel there is a need for another licensed premise as there are 7-10 already in the area. In addition, Ms McManus believes there is serious crime and disorder in the area and she could not fathom why the Police had not objected.

 

Whilst the Sub-Committee have sympathy with Ms McManus, need and commercial demand are not issues that the Licensing Authority can consider.  Also, the Police have not objected to the application and have not raised any issues regarding crime and disorder – there is no evidence to support the claims that this premise is a source of crime and disorder.
