The Sub-Committee considered an application for a variation of an existing premises licence at Thornhurst Manor, Holme Lane, Holme, Doncaster DN5 0LR

 

The Sub-Committee Members, the Applicant, their representative and the individuals making representations had received the agenda. A copy of the representations were attached to the report at Appendix F.

 

At the commencement of the hearing, the Chair welcomed all parties to the meeting, made introductions and outlined the procedure to be followed.

 

The Licensing Practitioner, Hayley Oxley, introduced the report and outlined the salient points in relation to the application.

 

The Applicant and their representative were in attendance, and made representations to the Sub-Committee and answered questions. The objectors were also in attendance and made representations and answered questions.

 

The meeting then adjourned to allow the Sub-Committee to deliberate on the application and reached the decision in private.

 

All parties were then invited back into the meeting to be informed of the Sub-Committee’s decision.

 

RESOLVED that the Sub-Committee, having considered the application for a variation of an existing Premises Licence for Thornhurst Manor, Holme Lane, Holme, Doncaster, DN5 0LR and taken into account the representations made and the evidence presented today, the steps that are appropriate to promote the Licensing Objectives, the Home Office Guidance and our Statement of Licensing Policy, decided not to allow the variation of the licence with regard to condition 1 at page 29, but the licence will be varied in respect of the condition relating to speakers used to relay amplified music, singing and speech provided as part of the regulation entertainment shall not be positioned outside the premises (condition 2 on page 29 of the agenda). This condition will be removed but the applicant will be subject to the conditions proposed by Environmental Health at Appendix B not including part of condition 8, which states [this restriction does not include weddings or other events to be held  in the marquee where music is controlled by the in house DJ] . With further conditions that any activities relating to the playing of amplified sound outside the building should finish at 10:00pm and admission should be by ticket only with a maximum attendance of 600.  The Sub-Committee imposed these additional conditions due to concerns relating to events in the past.

 

The Sub-Committee noted the concerns raised by those making representations, particularly around excessive noise, the Sub-committee also noted that the applicant acknowledged that events had not been managed appropriately in the past.  Concerns had also been raised regarding the effects on livestock which are kept nearby.  However, the Sub-Committee also noted that the applicant wishes to learn from previous events and to that end has arranged to meet a competent noise consultant in respect of future events, the Sub-Committee welcomed this.
